1.Is it necessary to call the Police to all incidents or no?
·The Police protocol must be submitted to the insurer before the insurance indemnification is paid out in all cases connected to criminal offenses (break-in, theft of the vehicle, theft of part of the vehicle). The reason is such that the insurance company will only cover those items from an invoice provided by LeasePlan, which are stated in the Police protocol, and are duly insured. The criminal offense is always investigated, regardless of the damage amount, and without the protocol the insurance company considers this claim to be unfounded, and will not pay any indemnification. In addition to that, if the Police find the offender, the insurance company will recover the costs from this offender, as well as the indemnification paid.
·In case of damage on the vehicle as a result of an accident, LeasePlan does not specifically require the Police protocol; we only need to know information whether the accident was investigated by the Police, and if so, we need to know the Police district and the file number. Accident protocols are filed in a database of the Czech Association of Insurers, and the insurer can view the protocol there. The necessity to call the Police in case of an accident results from the Law on operation of motor vehicles on public roads. Due to the fact that every accident means that property of a third person has been damaged (and also for the reason of clarifying the party in fault, in case of doubt), we recommend to call the Police in every case, not just when the damage amount exceeds CZK 50.000.
·An exception is when a stone from a vehicle in front of you damages the windshield. In this case the Police is not necessary, they would not be able to clearly identify the party in fault, and the case would be dismissed. Here it is necessary that the driver accepts his fault, and confirms this to the insurance company.
2.Is the driver entitled to get a replacement car due to a damage covered by
third-party liability insurance?
The damaged party is entitled to indemnification only if the purpose and the need are proved. If the lessee uses the vehicle for business purposes, he is entitled to get indemnification of costs connected to purposefully used replacement vehicle. However, the need for this replacement vehicle must be proved as well (for example, it’s not advised to rent a replacement vehicle and then have it parked in the garage for a week, or drive 10 km in total). Furthermore, it must be noted that the insurance company will subtract from the invoice amount so-called own costs. That means costs set by Expert standards (costs saved by not using driver’s own vehicle) will not be paid. On average, this amount is about CZK 2-4 per km, depending on vehicle type and make.
